LEGAL NOTICE
This information, which you have just accessed for the purposes of consulting or purchasing products, regulates the General Terms and Conditions of Use of the Online Shop of "TOKYO-YA" (hereinafter, "online store"), a registered trademark of TOKIO-YA, LDA, Crl (hereinafter, "Tokyo-ya", with registered office at Centro Empresarial de Alverca, EN 10, Km 127, Bloco B, Fracção 5, Letra L

USE OF THE ONLINE STORE
Use of this online store confers on you the status of Customer and implies full and unreserved acceptance of all the provisions contained in the General Terms and Conditions and the Privacy Policy in force at any time you access the Online Shop.
If you do not fully accept any of the conditions set out, you must not access/use the Online Shop.
Tokio-ya,LDA. reserves the right to amend and update the General Terms and Conditions from time to time and without prior notice to the Customer.
The processing of personal data carried out by Tokio-ya,LDA complies with the data protection legislation in force, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
All information provided by the Customer must be accurate and truthful. The Customer is obliged to update the information provided to Tokio-ya,LDA. whenever it changes. The Customer shall be expressly liable for any false or inaccurate statements made and for any damage caused to Tokio-ya,LDA. or third parties by the information provided.
Tokio-ya,LDA is the entity responsible for processing the personal data of its Customers, the lawful basis for which is the performance of this purchase and sale agreement.
In the event of a breach of the General Terms & Conditions, Tokio-ya,LDA reserves the right to exercise any and all legally prescribed actions. It also reserves the right, at its discretion, to terminate access to or use of the online store, with or without notifying the Customer.
Tokio-ya,LDA applies the appropriate and necessary technical and organizational security measures to ensure the security of information. However, the Customer is aware that the use of the online store may not be 100% secure, so there is a possibility that the information sent/received may be intercepted by unauthorized parties, and Tokio-ya,LDA cannot be held responsible for this.
The contractual proposal contained in the online store is addressed only to persons of legal age, and the Customer accepts that it may only be used by users who are over eighteen years of age and/or have full contractual capacity and are therefore able to take responsibility for the commitments resulting from the purchase and sale.
ONLINE ORDERING PROCEDURE
Step 1: Selection of items to include in your shopping cart (the price of which is indicated in Euros, including VAT at the legal rate in force).
The Customer hereby expressly accepts and acknowledges that:
- The images of the products presented in the online store are merely illustrative and the Customer should carefully and fully read the information on the essential characteristics of the items, and may, in case of doubt, contact the customer service line or go to the Tokyo-ya store in order to obtain any additional information or details;
- Tokio-ya,LDA will make every reasonable effort to include accurate and up-to-date information about the products available on the website;
- The prices of the items indicated in the online store correspond to the full amount payable by the Customer.
Step 2: Registration / Filling in the Form
In order to confirm your order, the Customer will have to fill in a form:
- Customer's full name/company name;
- Customer's telephone number and e-mail address;
- Customer's VAT number;
- Customer's full name or company name to appear on the invoice;
- Customer's VAT number to appear on the invoice;
- Customer's address to appear on the invoice.

-Permanent certificate number
Step 3 - Confirmation of the items and services included in the shopping cart, Buyer Data and Billing and Payment Data
The Customer undertakes to carefully check the data contained in their order summary, confirming the items and services selected in the shopping cart, Customer data and billing data, at which point they must go back to the previous steps in order to rectify them if they detect any nonconformity.
Tokio-ya,LDA will acknowledge receipt of the order by email to the email address provided by the Customer.
When Tokio-ya,LDA does not request payment in advance, the order will be settled upon delivery, preferably via an ATM terminal.
The invoice will be sent or delivered at the time of collection or delivery of the products purchased.
DELIVERY METHODS:
- Store Pickup
Customers may choose to pick up their online purchase at the Tokyo-ya Store, located at (Tokio-ya,LDA building).
At the time of collection, the Customer must check all the goods in the packaging, their quantity and condition.
In the event that the Customer detects defects or damage to the products and/or if they do not coincide with their order, the Customer must identify the damage or defects. The Customer should also contact Tokio-ya,LDA Customer Service on +351 21 959 5833 (Monday to Friday: 8:00-17:00).
- Home Delivery
The delivery service is only available to addresses with postal codes between 1000-000 and 8900-000.
In the event of unavailability of the products for delivery, Tokio-ya, LDA shall inform the Customer within a maximum of 2 days of becoming aware of such unavailability and shall reimburse the amounts paid if the Parties do not agree on a new delivery date.
The Customer undertakes to appear at the place on the date and at the time agreed for receipt of the goods. If it is not possible to deliver the goods due to the Customer's responsibility, the costs related to second deliveries shall be borne by the Customer. If, on the date and time agreed for Delivery, the Customer is absent from the agreed place, Tokio-ya, LDA will leave at that place, whenever possible, a document proving its visit, in which it will request that the Customer contact Customer Service to schedule a new date for the provision of the Service.
- CHECKING DELIVERY
Upon receipt, whether for Store Pickup or Home Delivery, the Customer must immediately check the condition of the products purchased, their quantity and condition. In the event of detecting defects or damage to the items and/or if the items do not match their order, the Customer should contact Tokio-ya, LDA Customer Service on +351 21 959 5833 (Monday to Friday: 8:00am to 5:00pm).
- TERMINATION OF THE CONTRACT
In accordance with the provisions of article 10 of Decree-Law no. 24/2014, of February 14 (updated by Decree-Law no. 78/2018, of October 15), the Customer has the right of withdrawal, which may be exercised, without the need to indicate the reason, up to 14 (fourteen) days after the date of delivery of the items, in which case the Customer agrees to be responsible for the payment of all transportation charges for collection of the items between the delivery address and the headquarters of Tokyo-ya, LDA.
-EXCHANGES AND RETURNS
The customer may return/exchange any product that is not perishable, due to a defect, within the legal deadlines for this purpose, however, if they wish to collect it, they will bear the transportation costs.
- COMPLAINTS
The Customer may address any complaints to Tokto-ya,LDA, through the contacts available on the contact page or by sending them to its head office.
- APPLICABLE LEGISLATION AND JURISDICTION
For any divergence arising in the contractual relations between the Parties, Portuguese law shall apply. Any question or dispute arising from the application, interpretation, integration or execution of this Contract, when it cannot be resolved by agreement of the parties, shall be submitted to the Portuguese courts. The consumer may also resort to the Alternative Dispute Resolution Entities available at www.consumidor.pt.
In the event of a consumer dispute, the consumer may resort to the network of consumer dispute arbitration centers authorized to carry out information, mediation and arbitration of consumer disputes.

- PRIVACY POLICY
Tokio-ya,LDA, collects the customer's personal data for the purpose of managing the customer account, billing, providing information, as expressly authorized for this purpose, all under the terms indicated above and the legislation in force.
This information is provided pursuant to Article 18 of Law 114/2015, of September 8.
The Customer declares that he/she is aware of and fully and unreservedly accepts these General Terms & Conditions of Online Purchase and Sale.
